The Supreme Court of India, during a hearing on air pollution in Delhi-NCR,said that the ban on firecrackers should not be restricted to Delhi-NCR but should be implemented across the country.
A bench comprising Justices B.R. Gavai and K. Vinod Chandran observed that clean, pollution-free air is not just the right of elite residents of Delhi but a right for people across India.
The bench added that policies on firecrackers should therefore be applicable nationwide. The court questioned why citizens outside Delhi should be denied the right to clean air, merely because the capital city houses the Supreme Court.
Justice Gavai remarked that if firecrackers are banned in Delhi, the prohibition should extend to the entire country.
Currently, state governments in Delhi-NCR have imposed a complete ban on the sale and storage of firecrackers following the Supreme Court’s strict directives.
This decision has been challenged by organizations including the Firework Traders Association, Indic Collective, and Haryana Firework Manufacturers.
The petitioners argued that many firecracker businesses held valid licenses until 2027–28, which are now being canceled due to previous court orders.
